Will Contests

Despite an attorney's best efforts, a will or a trust can lead to disputes after the death of the testator. During probate, when the will is submitted for approved by the court, objections may be raised by interested parties not named in the will, or heirs who believe that they did not receive proper recognition in the will. Our lawyer has many years of experience representing people challenging wills as well as executors and trustees defending against will contests.

Typical issues in a will contest may be:

  • The testator had diminished capacity (confused, senile, or demented)
  • The testator was subject to undue influence to create the will for another's benefit
  • Someone coerced the testator through threats or intimidation

  • The validity of the will is in question, and fraud or other criminal behavior is suspected
  • A missing heir appears
  • Children dispute an unequal division
